Effective February 3, 2019, New York Paid Family Leave will be expanded to include job protected – paid time off for employees to care for a covered family member who opts to act as an organ or tissue donor.
On Monday, November 5, 2018, Governor Cuomo signed the “Living Donor Protection Act” which amends the definition of a serious health condition to include “transplantation, preparation and recovery from surgery related to organ or tissue donation.” This is an important enhancement for New York State employees.
As a reminder, New York Paid Family Leave does not cover an employee’s own serious health condition.
What should you do now?
- Update employee handbooks with regards to organ donation and Paid Family Leave benefits
- Make sure the appropriate personnel (Human Resources, Supervisors, Managers, etc.) are familiar with the law’s requirements
