Medical loss ratio (MLR) rebates are due to policy holders by September 30th; therefore, carriers will soon be notifying employers if they have not met the minimum MLR thresholds and will distribute rebate checks as appropriate. For specific information on how to handle your rebate, we recommend you seek the advice of legal counsel.

As a reminder, the MLR provision of the ACA sets minimum percentages (82% – 85%) that carriers must spend on medical costs and quality improvement activities. Carriers that do not meet the minimum threshold are required to provide refund checks.
