On June 26, 2013 the Supreme Court of the United States ruled Section 3 of the Defense of Marriage Act (DOMA) unconstitutional. Section 3 barred the federal government from recognizing or granting equal benefits to same-sex couples lawfully wed in their home states.

While the decision is hailed as a huge victory for same-sex couples, the ruling leaves many questions unanswered and will change benefits administration for employers. We are advising employers wait for further guidance from the IRS before making internal policy decisions.
